Thank you for your interest in the ABEL Group's YouTube channel. YouTube is an Internet video portal that allows video publishers to post video clips free of charge and other users to view, rate and comment on them, also free of charge. YouTube allows the publication of all types of videos, which is why complete film and television programmes, but also music videos, trailers or videos made by users themselves can be accessed via the Internet portal.



Definitions

The privacy policy of the ABEL Group is based on the terms used in the General Data Protection Regulation (GDPR). For better comprehensibility, we would like to explain these terms in advance.


Personal data

Personal data is any information relating to an identified or identifiable natural person (hereinafter "data subject"). An identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.


Data subject

A data subject is any identified or identifiable natural person whose personal data are processed by the controller.


Processing

Processing means any operation or set of operations which is performed upon personal data, whether or not by automatic means, such as collection, recording, organisation, filing, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.


Restriction of processing

Restriction of processing is the marking of stored personal data with the aim of limiting their future processing.


Controller or person responsible for processing

The controller or person responsible for processing is the natural or legal person, public authority, agency or other body which alone or jointly with others determines the purposes and means of the processing of personal data. Where the purposes and means of such processing are determined by Union or Member State law, the controller or the specific criteria for its designation may be provided for under Union or Member State law.


Third party

Third party means any natural or legal person, public authority, agency or other body other than the data subject, the controller, the processor and the persons who, under the direct authority of the controller or the processor, are authorised to process the personal data.


Consent

Consent shall mean any freely given specific and informed indication of the data subject's wishes in the form of a statement or other unambiguous affirmative act by which the data subject signifies his or her agreement to the processing of personal data relating to him or her.


Entity responsible for the processing

Within the framework of a tiered provider relationship, there is joint responsibility within the meaning of Art. 26 DSGVO of the ABEL Group together with YouTube LLC for data processing on the YouTube channel of the ABEL Group. The operator of the YouTube channel of the same name is the ABEL Group.


Purpose and scope of data processing

The ABEL Group is present on social networks in order to present itself to users there and to communicate with them. The YouTube channel of the ABEL Group primarily serves as a video platform for the external presentation of the group of companies as an attractive employer and competent service provider. The ABEL Group provides an insight into everyday working life as well as the ABEL Group's fields of activity and informs about company news. YouTube members have the opportunity to publicly contact the ABEL Group. This is done by posting a public comment on the ABEL Group's company channel. Personal contact is based on voluntariness and in all cases is initiated by the user.


The ABEL Group uses personal data exclusively to analyse user behaviour via the statistics provided by YouTube and to communicate with the user if the user has initiated contact with the ABEL Group via the public comment function. YouTube provides personal data of users in aggregated and anonymised form. The following information is provided here by YouTube, for example: Followers, reach, demographics of users. These statistics do not allow any conclusions to be drawn about individual users. Information on personal data can therefore only be requested directly from YouTube. The ABEL Group can only view the public information of users. The user determines which information this is in his or her private settings. In addition, the user has the option of actively hiding Likes or no longer following the ABEL Group's corporate channel. More information on this can be found at https://www.youtube.com/account_privacy. The deletion of the data on the part of the ABEL Group takes place after the purpose has ceased to exist. When visiting the YouTube channel of the ABEL Group, user data may be processed outside the area of the European Union. In these jurisdictions, German or European data protection law is generally not applicable. This may make it more difficult to enforce users' personal rights. US providers certified for the Privacy Shield have undertaken to comply with EU data protection standards. ABEL Group is subject to YouTube's data protection requirements and has no influence on how YouTube uses personal data such as name, first name, IP addresses, etc. of users. The processing of the users' personal data is based on Art. 6 para. 1 lit. f. DSGVO. As the operator of a presence in a social medium, the ABEL Group has a legitimate interest in effectively informing users and communicating with users.

If the user has consented to the data processing - for example by clicking on a checkbox - the legal basis for the processing is Art. 6 para. 1 lit. a., Art. 7 DSGVO.


The data policy published by Google as the provider of the 'YouTube' service provides information on the collection, processing and use of personal data. It also explains which setting options Google and YouTube offer to protect the privacy of the data subject. When visiting the YouTube channel ABEL Group, YouTube as the responsible party collects personal data of the users. Such data collection by YouTube may also occur for visitors to this page who are not logged in or registered with YouTube. As a rule, YouTube uses and processes user data for market research and advertising purposes. For example, usage profiles can be created from the usage behaviour and the resulting interests of the users. The usage profiles can in turn be used, for example, to place advertisements within and outside of YouTube that presumably correspond to the interests of the users. For these purposes, cookies are usually stored on the users' computers, in which the usage behaviour and the interests of the users are stored. Furthermore, data may also be stored in the usage profiles irrespective of the devices used by the users (especially if the users are members of YouTube and are logged in to them).

In the event of requests for information and the assertion of user rights, it is pointed out that these can most effectively be asserted directly against Google. Only Google has access to users' data and can take appropriate measures and provide information directly.

The ABEL Group leaves it up to the user to use alternative means of communication - outside the network - to contact the company (website, telephone, email, etc.).


Google cookies

Google sets cookies to provide, protect and improve Google services. Cookies are small pieces of data used to store information in web browsers. Cookies are used to store or obtain IDs and other information on computers, phones and other devices. YouTube comment function

If a user leaves a public comment on the YouTube channel of the ABEL Group, these solely reflect the opinion of the user. The ABEL Group distances itself from any comments made by third parties and accepts no responsibility or liability whatsoever for the accuracy and completeness of the content or for any links placed in comments. The ABEL Group reserves the right to delete at any time user content (comments) that is inadmissible and/or contrary to public policy and/or infringes the rights of others.


Risk to your data on the internet

Both on the Internet in general and on social media platforms, there is the possibility of worldwide access or retrieval of the data and images posted, including from countries in which no or insufficient data protection standards exist. The ABEL Group, as the operator of this offer, can influence neither the access to its data via the Internet nor the use of this data and, in this respect, cannot assume any guarantee for the observance of data protection in this environment.


Personal data can be found on the Internet using suitable search engines and the persons depicted in images can also be identified under certain circumstances. This also makes it possible to create personality profiles by combining this data and information with other data available on the Internet and to open up additional possibilities of use, for example for advertising purposes. Due to the possibilities of worldwide retrieval and storage of data by other bodies or persons, further use by other bodies or persons or retrieval via archive functions of search engines cannot be ruled out in the event of a request for deletion and despite removal of your data and images.


Data subject rights of the users

Right of access:

You can request information from us about whether and to what extent we process your data.


Right to rectification:

If we process your data that is incomplete or inaccurate, you can request that we correct or complete it at any time.


Right to erasure:

You may request that we erase your data if we are processing it unlawfully or if the processing disproportionately interferes with your legitimate interests in protection. Please note that there may be reasons that prevent immediate deletion, e.g. in the case of legally regulated retention obligations.

Irrespective of the exercise of your right to deletion, we will delete your data immediately and completely, insofar as there is no legal or statutory obligation to retain data in this respect.


Right to restriction of processing:

You may request us to restrict the processing of your data if

  • you dispute the accuracy of the data, for a period of time that allows us to verify the accuracy of the data.
  • the processing of the data is unlawful, but you object to erasure and request restriction of data use instead,
  • we no longer need the data for the intended purpose, but you still need this data to assert or defend legal claims, or
  • you have objected to the processing of the data.


Right of objection:

If we process your data on the basis of legitimate interest, you can revoke this at any time; this would also apply to profiling based on these provisions. We will then no longer process your data unless we can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or the processing is for the assertion, exercise or defence of legal claims. You may object to the processing of your data for the purpose of direct marketing at any time without giving reasons.


Right to data portability:

You may request that we provide you with the data you have provided to us in a structured, commonly used and machine-readable format and that you may transfer this data to another controller without hindrance from us, provided that we process this data on the basis of a revocable consent given by you or for the performance of a contract between us, and this processing is carried out with the aid of automated procedures.

If technically feasible, you may request us to transfer your data directly to another controller.




Right to complain:

If you are of the opinion that we are violating German or European data protection law in the processing of your data, please contact us so that we can clarify any questions. Of course, you also have the right to contact the supervisory authority responsible for you, the respective state office for data protection supervision.

If you wish to assert any of the aforementioned rights against us, please contact our data protection officer. In case of doubt, we may request additional information to confirm your identity.


Right of withdrawal of consent:

If we process your data on the basis of consent, you can revoke this consent at any time without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.



Google is solely responsible for implementing these rights under Articles 15-20 of the GDPR with respect to data stored by Google after joint processing. You also have a right of objection and right of complaint, as described hereabove, vis-à-vis us.
